Limited License Agreement
& Limitation of Warranty
Access to GreatLists.com, our database of marketing list
information, is contingent upon your agreement to all of the following
terms of use. Please carefully read this entire page. This is a
legal agreement and your consent to these terms will be binding on
you, your employer and your fellow employees.
If you do not consent to one or more of these terms, do not
register. By registering and accessing
GreatLists.com, you are consenting to be bound by this
Limited License Agreement and Limitation of Warranty.
By accessing this site, you agree that you may not, and may not permit
others to, transmit electronically, download to electronic or hard
copy, post to a database or to the Internet, or otherwise reproduce in
any fashion any portion of our database of list information except as
expressly authorized in this Limited License Agreement.
You agree to access our list information only for the purpose of
determining whether and which lists you may be interested in
renting through us.
You are authorized to download into electronic storage and to print
hard copies of a reasonable quantity of list information in order to
accomplish this purpose.
You may share such electronic and/or printed copies with your fellow
employees for this purpose.
You agree that you will not share such copies with any other
third parties, including any other list broker or supplier, for any
purpose.
You agree that you will not attempt to download, either in electronic
or in printed copy format, our entire database of list data and/or
segment data or any substantial portion thereof.
By accessing the site, you agree that any and all disputes arising in
connection with the terms of this License Agreement and Limitation of
Warranty shall be resolved under and construed according to the law of
the Commonwealth of Virginia, exclusive of its choice of law
principles. You further agree that any such proceedings may be brought
only in the state or federal courts of Virginia and that you will
submit to the jurisdiction of said courts.
Finally, by accessing the site, you accept the following Limitation of
Warranty:
GreatLists.com DISCLAIMS ALL WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND
FITNESS FOR YOUR PARTICULAR PURPOSES. WE WILL NOT BE LIABLE FOR ANY
DAMAGE OR LOSS OF ANY KIND ARISING OUT OF OR RESULTING FROM YOUR
POSSESSION OR USE OF OUR LIST INFORMATION, INCLUDING, BUT NOT LIMITED
TO, LIABILITY ARISING FROM YOUR RELIANCE ON THE CONTENTS OF THE LIST
INFORMATION, ERRORS IN LIST INFORMATION, AND DATA LOSS OR CORRUPTION,
REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRACT OR
OTHERWISE. IF THE FOREGOING LIMITATION IS HELD TO BE UNENFORCEABLE,
OUR MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF THE FEES
EARNED BY US ON LISTS RENTED BY YOU SUBSEQUENT TO YOUR ENTERING INTO
THIS AGREEMENT. THE REMEDIES AVAILABLE TO YOU AGAINST US UNDER THIS
AGREEMENT ARE EXCLUSIVE. NOTE THAT SOME STATES DO NOT PERMIT
LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES, SO CERTAIN OF THE ABOVE LIMITATIONS MAY NOT
APPLY TO YOU.
